Profession of Bailiffs : President Paul Biya Gives Fresh Impetus

A presidential decree signed on January 25, 2023 lays down the rules and regulations and organisation of the profession of Bailiffs and Enforcement Agents.

The President of the Republic on January 25,2023 signed a decree which lays down the general rules applicable to the profession of Bailiffs and Enforcement Agents, and the organisation and practice of the said profession. Divided into eight chapters and containing 43 articles, the document spells out requirements for admission into the profession of Bailiff, their rights and obligations, professional card of Bailiffs and their discipline. Various legal dispositions governing the profession are therein the presidential decree.
On the requirements for admission to the profession of Bailiff, the decree states that the concerned must be of Cameroonian nationality and must be at least 23 years of age. The said Bailiff must also be a holder of an LLB from a Cameroonian university or an equivalent foreign certificate in law recognised by Cameroonian authorities and must have equally passed the bailiff training course. Article 6(1)d of the Presidential decree stipulates that the Bailiff to be admitted must be of good character and must not have been dismissed from public or semi-public office, removed as a law official, or struck off the list of pupil lawyers or the roll of the Bar offences against honour, probity or morality. 
As concerns the rights of Bailiffs, Chapter three of the decree states that they shall be assisted by sworn Clerks and Clerks, and may designate sworn Clerks to deputise for him/her in respect of all deeds under the competence of his chambers, save in cases of certified, seizure and verification of reports. 
How to obtain a professional card by a Bailiff is equally highlighted in the Presidential decree. Going by Article 20 of the document, the professional card of Bailiffs shall be issued by the Minister in charge of justice, upon presentation by the National Chamber of Bailiffs, of a file comprising for each Bailiff, a copy of decree of appointment, copy of oath-taking...
