Order N°001216/MINFOPRA of 06 April 2017 to create the Ad hoc Commission in charge of the special recruitment of Anglophone legal personnel for the jurisdictions of the North-West and South-West Courts of Appeal for the 2017 – 2020 financial years

The Minister of the Public Service and Administrative Reform, hereby orders as follows:

Part 1: GENERAL PROVISIONS

ARTICLE 1.- This order creates the ad hoc Commission in charge of the special recruitment of legal personnel of English expression into the Public Service for the jurisdictions of the North West and South West Courts of Appeal for the 2017 - 2020 financial years.
ARTICLE 2.- The Commission, chaired by the Minister of the Public Service and Administrative Reform, shall be responsible for designing, coordinating and evaluating the operations that would lead to the special recruitment of pupil magistrates and student court
registrars of English expression into the National School of Administration and Magistracy for the 2017 - 2020 financial years.
In this regard, the Commission shall:
carry out all necessary studies for the recruitment and draw up terms of reference;
adopt the timetable for the execution of the recruitment;
− propose general and specific selection criteria;
− receive and study application files in accordance with the selection criteria retained;
− supervise the written and oral selection tests;
− check the authenticity of the required recruitment certificate;
− draw up a provisional list of selected candidates;
− supervise the communication strategy;
− adopt the Committee's draft budget.

PART II : COMPOSITION AND FUNCTIONING

ARTICLE 3.- (1) the Commission shall be composed as follows:
Chairperson: The Minister of the Public Service and Administrative Reform
Vice-chairpersons:
− The Secretary General of the Ministry of the Public Service and Administrative Reform;
− The Secretary General of the Ministry of Justice.
Members:
a) a representative of the Secretariat General of the Presidency of the Republic;
b) a representative of the Secretariat General of the Prime Minister's Office;
c) a representative of the Ministry in charge of Finance;
d) a representative of the Ministry in charge of Higher Education.
e) Representatives of the Ministry of Justice:
− The Director of Legal Professions;
− The Director of General Affairs;
− The Director of Penal Affairs and Pardons.
f) Representatives of the Ministry of the Public Service and Administrative Reform:
− The Inspector General;
− The Head of the Regulation, Forecasts and Staff Management Division;
− The Head of the Sovereignty Ministries Division;
g) Representatives of the National School of Administration and Magistracy:
− The Head of the Magistracy and Registry Division;
− The Director of Academic Affairs;
− The Head of the Legal Section.
(2) The chairperson may invite any physical or corporate person, based on their competence or experience on issues on the agenda, to take part in the Commission's deliberations. Such an invitee shall have consultative voting rights.
ARTICLE 4.- (1) The Commission shall meet as required upon convening by the chairperson.
(2) Minutes shall be drawn up after deliberations of each meeting.
ARTICLE 5.- (1) The Commission's deliberations shall be valid only when, at least, half of its members are present.
(2) Decisions taken shall be by simple majority of the members present. In the event of a tie the chairperson shall have the casting vote.
ARTICLE 6.- The chairperson may, where the need arises, create work groups to carry out specific tasks.
ARTICLE 7.- The Commission shall be assisted by a Technical Secretariat which shall:
− prepare the Cornmission's meetings and files;
− draw up the Commission's minutes and reports;
− monitor the progress of work, execution Commission's directives and draw up periodic reports pertaining thereto;
− exploit the reports from work groups;
− collect, centralise and store the Commission's working documents;
− perform any tasks the Commission assigns it which may help in the accomplishment of its missions;
− follow-up the execution of the Commission's budget.
